Rubbish Removal Brent Service Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Removal Brent provides rubbish removal and waste collection services to residential and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 "Company" means Rubbish Removal Brent, the provider of rubbish removal and waste collection services.
1.2 "Customer" or "you" means the person, firm or organisation requesting the services of the Company.
1.3 "Services" means the rubbish removal, waste clearance, waste collection, loading, transportation and disposal services provided by the Company.
1.4 "Site" means the property, premises or location where the Services are to be carried out.
1.5 "Waste" means the materials, items and rubbish to be removed from the Site as agreed between the Company and the Customer.
2. Scope of Services
2.1 The Company provides rubbish removal and waste collection services including, but not limited to, general household waste, garden waste, bulky items, and certain commercial waste. Availability of specific services may vary and is subject to assessment at the time of booking or upon arrival at the Site.
2.2 The Company will collect Waste from an agreed point at the Site. Unless otherwise agreed, the Customer must ensure that Waste is accessible, safely presented and ready for collection at the agreed time.
2.3 The Company reserves the right to refuse to collect any items which, in the reasonable opinion of the Company, are unsafe to handle, not properly described at the time of booking, or are prohibited by law or by waste regulations.
3. Booking Process
3.1 Bookings may be made by telephone, email, online form or other booking channels made available by the Company from time to time.
3.2 When making a booking, you must provide accurate and complete information regarding:
(a) the address of the Site and any access restrictions;
(b) the type and approximate volume or weight of Waste to be removed;
(c) any items requiring special handling; and
(d) preferred date and time for collection.
3.3 Any quotation provided prior to attendance at the Site is an estimate based on the information supplied by the Customer. The final price will be confirmed once the team has inspected the Waste on arrival at the Site.
3.4 By confirming the booking, you warrant that you have the authority to allow the Company access to the Site and to authorise removal of the Waste.
3.5 The Company will use reasonable efforts to attend the Site at the agreed date and time, but all time estimates are approximate and subject to traffic, weather, operational and other conditions outside the Company’s control.
4. Access and Customer Obligations
4.1 The Customer must ensure that the Company has clear, safe and reasonable access to the Waste at the Site on the agreed date and time.
4.2 The Customer must ensure that driveways, entrances, lifts, stairways and passageways are suitable for the safe movement of the Company’s personnel and equipment.
4.3 The Customer is responsible for securing any permissions, permits or authorisations required for the Company’s vehicles to enter or park at or near the Site.
4.4 If access is delayed or denied, or if the Waste is not available for collection upon arrival, the Company may charge a waiting fee, an aborted visit charge, or adjust the service time, at its reasonable discretion.
5. Pricing and Quotes
5.1 Prices are generally based on the volume, weight, type of Waste and the time required for loading. Minimum charges may apply.
5.2 Any quotation given before viewing the Waste is an estimate only and is not binding on the Company. The final price will be confirmed on site before the work commences, once the Waste has been assessed.
5.3 If the Customer does not agree to the revised price following on-site assessment, the Company will not be obliged to carry out the Services and may charge a call-out or attendance fee to cover costs incurred.
5.4 All prices are quoted in pounds sterling and may be inclusive or exclusive of VAT, which will be made clear at the time of booking.
6. Payments
6.1 Unless otherwise agreed in writing, payment is due in full on completion of the Services at the Site.
6.2 The Company accepts payment by cash, debit card, credit card or other payment methods notified to the Customer at the time of booking.
6.3 For business customers with agreed credit terms, invoices are payable within the period stated on the invoice. The Company may charge interest on late payments at the statutory rate together with reasonable administration costs associated with debt recovery.
6.4 The Company reserves the right to suspend or refuse Services where any amount remains unpaid after the due date.
7. Cancellations and Amendments
7.1 The Customer may cancel or amend a booking by giving reasonable notice to the Company.
7.2 If the Customer cancels the booking more than 24 hours before the scheduled collection time, no cancellation fee will normally apply.
7.3 If the Customer cancels within 24 hours of the scheduled collection time, the Company reserves the right to charge a cancellation fee to cover costs incurred, including but not limited to allocated vehicle time and staff.
7.4 Where the Company attends the Site and is unable to carry out the Services due to reasons beyond its control, including but not limited to lack of access, insufficient permission to remove the Waste, or misdescription of the Waste, the Company may charge an aborted visit fee.
7.5 The Company reserves the right to cancel or reschedule a booking at any time due to operational reasons, unsafe conditions, extreme weather, vehicle breakdown or other events beyond its control. In such cases, the Company will use reasonable efforts to notify the Customer and to offer an alternative appointment.
8. Waste Regulations and Prohibited Items
8.1 The Company operates in accordance with applicable waste management legislation and regulations in the United Kingdom. Waste will be transported and disposed of only at authorised facilities.
8.2 The Customer must not present for collection any hazardous waste or items that require specialist disposal, including but not limited to asbestos, clinical or medical waste, large quantities of chemicals, solvents, oils, gas cylinders, explosives or radioactive materials, unless specifically agreed in writing in advance.
8.3 Where hazardous or prohibited items are discovered after loading has commenced, the Company may, at its discretion:
(a) refuse to remove such items;
(b) return such items to the Site; or
(c) charge additional fees for specialist handling and disposal where legally permitted.
8.4 The Customer is responsible for informing the Company of any Waste that may pose a risk to health and safety or require particular handling. Failure to do so may result in additional charges or refusal of service.
9. Title to Waste and Duty of Care
9.1 Title to the Waste transfers to the Company only once it has been loaded onto the Company’s vehicle and full payment has been received, unless agreed otherwise in writing.
9.2 The Company will exercise a duty of care in handling and disposing of Waste and will use reasonable endeavours to recycle and recover materials where practical.
9.3 The Customer remains responsible for any Waste left at the Site, including any items that the Company declines to remove.
10. Damage to Property
10.1 The Company will take reasonable care when carrying out the Services. However, the Customer must notify the Company in advance of any fragile surfaces, hidden services, structural weaknesses, or other features at the Site that may be susceptible to damage.
10.2 The Customer agrees that any instructions given to the Company’s personnel to move items through narrow spaces, over delicate flooring, or in other challenging conditions are carried out at the Customer’s risk unless the Company has expressly agreed to accept liability.
10.3 Any damage or loss believed to be caused by the Company must be reported to the Company in writing as soon as reasonably practicable and, in any event, within 48 hours of completion of the Services, together with supporting evidence.
11. Liability and Limitations
11.1 Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded under applicable law.
11.2 Subject to clause 11.1, the Company shall not be liable for:
(a) any indirect or consequential loss, including loss of profits, business interruption or loss of opportunity; or
(b) any loss arising from inaccurate information provided by the Customer.
11.3 Subject to clause 11.1, the total aggregate liability of the Company arising out of or in connection with the provision of the Services, whether in contract, tort or otherwise, shall be limited to the total price paid or payable by the Customer for the specific Services giving rise to the claim.
11.4 The Company shall not be liable for delays or failure in performance of its obligations where such delay or failure is caused by events beyond its reasonable control, including but not limited to adverse weather conditions, traffic congestion, accidents, breakdowns, strikes, or acts of government or public authorities.
12. Customer Warranties
12.1 The Customer warrants that:
(a) they are the owner of the Waste or have full authority from the owner to arrange its removal;
(b) the Waste does not include any items that are illegal to possess, transfer or dispose of;
(c) all information provided to the Company is accurate and complete; and
(d) they will comply with these Terms and Conditions.
13. Complaints
13.1 If you are dissatisfied with any aspect of the Services, you should contact the Company as soon as possible, providing full details of your complaint.
13.2 The Company will investigate complaints in a fair and timely manner and will seek to resolve them where reasonably possible.
14. Data Protection and Privacy
14.1 The Company will collect and process personal information about the Customer in order to provide the Services, administer bookings, process payments and manage customer relationships.
14.2 The Company will handle personal data in accordance with applicable data protection laws and will take reasonable steps to keep such data secure.
15. Variations to Terms
15.1 The Company reserves the right to update or amend these Terms and Conditions from time to time. Any changes will apply to Services booked after the date on which the revised Terms and Conditions are published or otherwise notified to the Customer.
15.2 Continued use of the Services after such changes take effect will constitute acceptance of the updated Terms and Conditions.
16. Severability
16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.
17. Governing Law and Jurisdiction
17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.
18. Entire Agreement
18.1 These Terms and Conditions constitute the entire agreement between the Company and the Customer in relation to the provision of the Services and supersede any prior discussions, correspondence, negotiations or understandings.
18.2 No other terms, whether implied by trade, custom, practice or course of dealing, shall apply unless expressly agreed in writing by the Company.
